According to the Regulation on Commercial Communication and Commercial Electronic Messages (“Regulation“), natural or legal persons wishing to send commercial electronic messages must register with the Electronic Messages Management System (tr. İYS) and upload recipients’ consents to the İYS.
Recipients whose consents are not on the İYS cannot be contacted through commercial electronic messages.
With the amendment of the Regulation published in the Official Gazette on August 28, 2020, the deadline for the registration and integration of service providers and the upload of recipients’ commercial electronic message consents were extended until December 1, 2020.
Conclusion
According to the Regulation, service providers wishing to send commercial electronic messages must register with the İYS and transfer recipients’ consents to the İYS. All relevant real or legal persons must complete their İYS registrations and transfer recipients’ consents to the İYS by December 1, 2020.
