The Data Protection Board announced standard contractual clauses for international data transfers on May 16, 2018. To access the announcement, which is written in Turkish, please click here.
What Does the Announcement Say?
The announcement informs the minimum required content that data controllers must prepare for international data transfers, as per Article 9/2(b) of the Data Protection Law No. 6698.
The minimum content is very similar to the European Union’s model contractual clauses.
The announcement referenced two separate documents containing standard contractual terms, namely the “Transfer From Data Controller to Data Controller” and “Transfer From Data Controller to Data Processor”.
Conclusion
Data controllers should review these standard contractual terms carefully and use them as templates for their agreements in relation to international data transfers.
