The Personal Data Protection Authority (“Authority“) recently published the Information Note on Data Protection Law and Glossary of Terms, Guideline on Data Privacy and Guideline on Fulfillment of the Obligation to Inform on its website.
What’s New?
Documents published by the Authority provide detailed information and explanations regarding data protection within the framework of the Personal Data Protection Law (“Law“). In this regard, the information note explains the provisions of the Law, emphasizing the purposes of the provisions and the grounds on which they are based. The information note also contains a glossary of the terms under the Law. The information note and glossary of terms are available here (in Turkish).
The Authority also published a Guideline on Data Privacy in English, which provides general information on data protection under the Law. The Guideline on Data Privacy is available here.
The Authority has also recently published on its website the Guideline on Fulfillment of the Obligation to Inform in order to present good practice examples and provide guidance on the preparation of information notes on the processing of personal data. The guideline is available here.
Conclusion
The Authority continues to provide guidance on data controllers’ obligations and data subjects’ rights under the Data Protection Law. Considering that failing to comply with the data protection obligations may result in administrative fines ranging from TRY 5,000 to 1,000,000, data controllers must carefully follow the Authority’s guidance on data controllers’ obligations and take the necessary steps to ensure compliance.
