European Data Protection Board (“EDPB”) recently published the Guidelines on Territorial Scope of the GDPR (“Guidelines”) as adopted after public consultation (Guidelines 3/2008 on the territorial scope of the GDPR (Article 3) – Version 2.1 of 7 January 20201). The Guidelines provide guidance and clarification on the application and interpretation of Article 3 of the General Data Protection Regulation (“GDPR” or “Regulation”) of the European Union (“EU”), which regulates the scope of GDPR’s application including its extraterritorial application (i.e. to non-EU data controllers).
