According to the Regulation on Commercial Communication and Commercial Electronic Messages (“Regulation“), natural or legal persons wishing to send commercial electronic messages must register with the Electronic Messages Management System (tr. İYS) and transfer recipient consents to the İYS.
Further to the amendments to the Regulation published in the Official Gazette on August 28, 2020, the deadline for the transfer of consents to the İYS was extended to December 1, 2020.
In this regard, recipients of these electronic messages should review and accept or revoke their consents registered with the İYS until January 16, 2021. After this date, commercial electronic messages sent will be considered as sent based on a valid consent.
The Ministry of Trade is authorized to further extend the foregoing deadlines by six months, considering the nature of the service providers and number of electronic message consents to be transferred to the İYS.

Conclusion
According to the Regulation, service providers wishing to send commercial electronic messages must register with the İYS and transfer recipient consents to the İYS. In that regard, all relevant real or legal persons must complete their İYS registrations and transfer recipient consents to the İYS by the relevant deadlines.
